In the last days of October, the State Property Fund of Ukraine (SPFMU) gained control over 49% of the authorized capital of LLC "Alliance Holding", which manages a network of Shell gas stations in Ukraine. This became possible thanks to court decisions and the actions of the Ministry of Justice, as evidenced by the data of the youcontrol analytical platform.
According to the new ownership structure, the State Property Fund owns a significant share of "Alliance Holding" shares. In April of this year, FDMU took control of 49% of the Shell gas station network, as this share was confiscated in connection with its connections with Russian oligarch Eduard Khudainatov, who previously held management positions at Rosneft.
Shortly after the transfer of the asset to management, the FSMU announced its intention to put this asset up for public auction. On May 22, the head of the Federal Ministry of Finance, Vitaliy Koval, noted that not only Ukrainian companies, but also foreign investors have shown interest in the asset. At the same time, he expressed hope that the global company Shell could buy the seized share.
However, the international Shell does not agree with the decision to seize part of its assets and is currently fighting a legal battle with the Ukrainian authorities. This issue may drag on for several years, which jeopardizes the stability of investments in the gas station network in Ukraine.
The importance of this situation underscores the fact that the recovery of business assets is critical to the country's investment climate. The court case surrounding "Alliance Holding" may significantly affect future deals and the development of the gas station market in Ukraine, as any uncertainty may scare off potential investors.
